Any reproduction, representation, modification, translation, adaptation, exploitation or distribution, in whole or in part, by any means whatsoever, without prior written authorization, is strictly prohibited and constitutes an infringement punishable under articles L.335-2 et seq. of the French Intellectual Property Code.
Productions involving or assisted by artificial intelligence (image generation, visuals, voice-over, video sequences) follow the same property regime. The patrimonial rights on final deliverables provided to a client are subject to an explicit assignment within the corresponding service contract; in the absence of such a contract or express mention, no assignment is granted.
Limitation of liability
The Dark Agency takes all reasonable steps to ensure the accuracy, timeliness and accessibility of the information published on this site. The agency cannot, however, be held liable for errors or omissions, temporary unavailability of the service, or the possible presence of viruses or any other element likely to alter the user's equipment or data.
Hyperlinks pointing to third-party websites are provided for informational purposes only. The Dark Agency exercises no control over these sites and cannot be held liable for their content, their personal data practices, or any consequences arising from their consultation by the user.
Conditions and editorial rights
The following conditions apply to any business relationship engaged with The Dark Agency. They complement, without replacing, the service contract concluded with each client.
Right to refuse a project
The Dark Agency reserves the right, at its sole and entire discretion, to refuse or interrupt any project that does not match its ethics, values or professional commitments, without being required to justify its decision. No reproach, dispute, legal action or claim for compensation may be raised on this ground.
The following are notably considered contrary to our ethics, without this list being exhaustive or limiting:
- promotion of weapons, ammunition or defence equipment;
- promotion of drugs, hard alcohol with incentive intent, or tobacco products;
- promotion of gambling, sports betting or any form of games of chance;
- pornographic, sexually explicit or sexually suggestive content involving adults outside a lawful editorial framework;
- content involving minors outside a benevolent family setting and without parental authorization;
- deepfakes or synthetic content with political, electoral, defamatory or misleading purposes;
- projects contrary to fundamental human rights, individual freedoms or democratic principles;
- any content aimed at deceiving, manipulating, harassing, denigrating or harming a person, group or institution.
Editorial rights over faces and human likenesses
In the context of video, photographic and AI-assisted productions, The Dark Agency reserves three distinct and cumulative editorial rights, exercisable at its sole discretion:
- Discretionary blurring — the agency may blur, mask or remove from frame any face or identifying feature it deems necessary to protect (non-consenting bystanders, background subjects, identifiable minors, artistic or narrative choice), even in the absence of an explicit request from the subject concerned.
- Refusal to generate without consent — the agency refuses to generate, by AI or any other means, the face or recognizable likeness of a real person without their prior written consent. This applies in particular to public figures, political figures, established personal brands and any identifiable person, including in a parodic or satirical context.
- Discretionary refusal — the agency reserves the right to refuse, at its sole discretion, any generation, modification or distribution of a face it deems problematic on ethical, legal, deontological or reputational grounds, without being required to justify its decision.
The client acknowledges having taken note of these editorial rights prior to any order and accepts that they apply to them without consideration or compensation.
Personal data
The conditions of processing of personal data collected through the forms and services on this site are detailed in our privacy policy, in accordance with Regulation (EU) 2016/679 (GDPR) and French Act no. 78-17 of 6 January 1978 as amended.
Applicable law and jurisdiction
This legal notice and the use of this site are governed by French law. Any dispute relating to their interpretation, performance or validity falls under the exclusive jurisdiction of French courts, save for any mandatory provision to the contrary.
In accordance with article L.612-1 of the French Consumer Code, consumers who have encountered an unresolved dispute may free of charge use a consumer mediator. The contact details of the competent mediator may be communicated upon simple request at the contact address above.
